Temporary Rules Now Permanent

On March 28, 2019, the Early Learning Council adopted several temporary child care rules, making them permanent. Here is a summary of those changes:

Applicable to all providers:

Central Background Registry (CBR)

Rules update the crimes that are considered disqualifying conditions for enrolling in the CBR. Also, adds programs that are unable to be licensed to the individuals subject to enrollment in the CBR.


Applicable to Certified Centers, Certified/Registered Family homes and Regulated Subsidy:

Safe Sleep

  • Removes the rule allowing sleeping infants who arrive at the facility in car seats to remain in the car seat until they awaken.
  • Aligns rules to use the same terms to describe appropriate safe sleep surfaces (crib, portable crib, bassinet or playpen).
  • Indicates that the Office of Child Care (OCC) may notify parents of any valid safe sleep non-compliance, and makes clear that all serious valid complaints and serious non-compliance letters must be posted for parents.


Applicable to Certified Centers, and Certified/Registered Family homes:

Updates and clarifies the requirements for water testing and the submission of test results to the OCC.


Applicable to Certified Centers:

Training Requirements

Corrects inconsistencies in staff training requirements for Aide I’s.
